NON AEDIFICANDI OR NON ALTIUS TOLLENDI EASEMENT

Pursuant to Section L471-1, Code de l'urbanisme (French Town Planning Regulations), where, in accordance with town planning provisions, planning permission is subject, with regards to legal distances between buildings, to the creation, on an adjoining parcel, of easement rights of non aedificandi or non altius tollendi, such easements are referred to as "de cours communes", and may, failing mutual agreement between the parties involved, be established via a court order in conformance with provisions set forth by decree.

Surface Hors Oeuvre Brute - SHOB

GROSS FLOOR AREA - GFA

In France, the Surface Hors Oeuvre Brute (SHOB) of a building  means the overall area of that building on each floor including the thickness of external walls, floor areas of convertible lofts and basements, balconies, loggias and walkable roof terraces - see Section R. 112-2, Code de l'urbanisme (French Town Planning Regulations).

Surface Hors Oeuvre Nette - SHON

NET FLOOR AREA - NFA

In France, the Surface Hors Oeuvre Nette (SHON) of a building is calculated by deducting the floor areas of non-convertible lofts and basements, open areas, parking spaces, agricultural units, and greenhouses for production use from the Surface Hors Oeuvre Brute (SHOB) of the same building - see Section R. 112-2, Code de l'urbanisme (French Town Planning Regulations).
